Terms of Service
1. Agreement and eligibility
These Terms govern use of RED / BLUE and purchases of Captain promotional placement. By using the service or submitting a paid Captain purchase, you agree to these Terms and the Captain Rules. Paid Captain purchasers must be at least 18 years old and legally able to enter a binding contract. If you act for a company or other organization, you represent that you have authority to bind it.
2. Free participation
Joining RED or BLUE is free. Accepted joins determine the live crowd score for the applicable round. Captain payments never buy joins, votes, participation, score influence, prizes, payouts, investment returns, donations, stored value, or any ownership interest.
3. What a Captain purchase is
A paid Captain purchase is a limited, revocable, non-exclusive digital advertising placement in the selected RED or BLUE Captain slot, subject to these Terms and the Captain Rules. A successful takeover is protected for the remainder of its activation round plus the entire following round. After that protected period, the Captain may remain until displaced, removed, suspended, or the service changes.
No minimum number of impressions, views, clicks, visitors, conversions, sales, geographic reach, audience composition, or other performance result is promised. Captain placement does not imply endorsement by RED / BLUE, RED or BLUE participants, or the owner of any submitted brand, account, website, or destination.
4. Bids, effective bids, and paid credit
Effective bids increase in at least $1 increments. Previously captured valid spend may remain as bid credit for the same resolved Captain identity on the same side, so a returning Captain may owe only the additional amount required to reach a new effective bid. Bid credit is only an accounting mechanism for Captain bidding. It is not a wallet, deposit, gift card, stored-value account, transferable balance, or right to cash, withdrawal, redemption, or repayment.
5. Authorization, capture, and expiration
RED / BLUE may use payment authorization before capture. Your payment method may be authorized when you submit a challenge without being charged immediately. If your challenge becomes the highest eligible challenge while the authorization remains valid, RED / BLUE may capture the amount shown at checkout. Superseded, ineligible, expired, or otherwise unsuccessful authorizations may be canceled or allowed to expire without Captain placement. If an authorization expires or capture fails, no paid Captain purchase is completed and no paid bid credit is created for that attempted charge.
6. Delivery
A paid Captain purchase is delivered when the qualifying Captain destination is activated in the purchased Captain slot and remains eligible for display through the promised protected-placement period, subject to permitted suspension or removal under these Terms. Temporary interruptions caused by routine maintenance, internet or infrastructure outages, third-party failures, or events outside RED / BLUE's reasonable control do not create a guarantee of uninterrupted display.
7. Refunds, cancellations, and disputes
Superseded or unsuccessful authorizations are released or allowed to expire and are not Captain purchases. If RED / BLUE captures payment but fails because of a platform error to activate the purchased placement, RED / BLUE will refund the affected incremental captured payment. If a platform-caused failure materially prevents delivery during the protected period, RED / BLUE may provide a reasonable refund or service credit based on the undelivered portion.
Completed protected placement is final and non-refundable except where required by law. A Captain removed because of prohibited content, fraud, malware, sanctions concerns, infringement, impersonation, lack of authority, chargeback abuse, or another advertiser-caused violation is not entitled to a refund except where required by law. A payment dispute or chargeback may cause suspension or removal of the Captain and may invalidate disputed paid bid credit. Additional details appear in the Payment, Cancellation & Refund Policy.
8. Destination authority and intellectual property
By submitting a website, domain, social profile, handle, brand, name, logo, image, description, or other destination, you represent that you own or control it or are authorized to advertise or promote it, and that RED / BLUE may display and cache public metadata reasonably necessary to provide the placement. You may not impersonate another person or organization or falsely imply sponsorship, affiliation, endorsement, or authorization.
You are responsible for ensuring that your destination and claims comply with applicable law and do not infringe trademark, copyright, publicity, privacy, or other rights. RED / BLUE may request evidence of authority and may reject, quarantine, disable, or remove a destination while a complaint is reviewed.
9. Advertising and prohibited conduct
Captain placements must comply with the Advertising Policy and Captain Rules. RED / BLUE may reject or remove unlawful, deceptive, infringing, malicious, fraudulent, abusive, unsafe, payment-network-prohibited, sanctioned, or otherwise high-risk content or destinations. Political or issue-oriented advertising is not categorically prohibited, but every advertiser remains solely responsible for all sponsorship, disclaimer, registration, reporting, targeting, and other legal requirements that may apply.
10. Moderation, suspension, and termination
RED / BLUE may reject, suspend, quarantine, disable outbound links, remove a Captain, pause bidding, or terminate access when reasonably necessary for security, fraud prevention, legal compliance, payment integrity, rights protection, service integrity, or enforcement of these Terms or the Rules. RED / BLUE may also modify or discontinue features or the service.
11. Service disclaimers
To the fullest extent permitted by law, RED / BLUE is provided on an "as is" and "as available" basis without warranties of uninterrupted availability, merchantability, fitness for a particular purpose, non-infringement, advertising performance, traffic, conversion, or business outcome. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, the Operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost revenue, lost business, loss of goodwill, or loss of data arising from the service. The Operator's aggregate liability arising from a paid Captain transaction will not exceed the amount actually paid by the claimant for the specific Captain placement giving rise to the claim. These limitations do not apply to liability that cannot legally be limited or excluded.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Operator from third-party claims, damages, liabilities, costs, and reasonable expenses arising from your submitted destination, advertising content or claims, infringement, lack of authority, unlawful conduct, or material breach of these Terms or the Captain Rules, to the extent permitted by law.
14. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute not resolved informally must be brought exclusively in a state court of competent jurisdiction located in Collin County, Texas, or, where federal jurisdiction exists, the federal court serving Collin County, Texas. You and the Operator consent to personal jurisdiction and venue in those courts.
15. Changes and contact
RED / BLUE may update these Terms prospectively. The effective date above identifies the current public version. Material changes will apply only as permitted by law. Questions, notices, privacy requests, and legal complaints may be sent to info@redblue.lol.
